Description
Luca Lucarini is a Toronto-based senior associate in our Privacy and Cybersecurity and Litigation and Dispute Resolution groups.

Luca provides risk management and regulatory compliance advice to clients on privacy, data security, anti-spam (CASL), telemarketing and AI governance matters. A firm disbeliever in the “one-size-fits-all” approach, Luca calibrates his advice to each of his clients’ individual risk tolerance and operational posture. He is adept at mitigating regulatory risk through the development of both public-facing and internal notices, policies and processes; and has managed several comprehensive, organization-wide gap analysis and remediation projects undertaken in response to Canada’s evolving privacy legislation. Luca regularly drafts and negotiates the privacy and data security elements of various technology-related agreements (SaaS, PaaS and IaaS), as well as all manner of data processing agreements and addendums.

Luca’s clients also rely on him for sound, timely and pragmatic advice on regulatory issues that arise in the course of their day-to-day activities, including in the context of employee privacy, data subject requests and complaints, and public-sector access-to-information requests. Luca assists clients experiencing data incidents by advising on remediation, notification and reporting obligations, as well as interfacing with regulators. He also provides risk assessment and mitigation advice for M&A and other commercial transactions.

Luca’s advisory work is complemented by his litigation practice, which focuses on public and administrative law matters, as well as privacy-related civil proceedings. Luca’s public and administrative law practice involves representation before various boards, agencies and tribunals, as well as judicial reviews of administrative action and constitutional litigation. He has acted for clients before the Ontario Superior Court, the British Columbia Supreme Court, the Federal Court of Canada, the Information and Privacy Commissioner of Ontario, the Information and Privacy Commissioner of British Columbia, the College of Registered Nurses of Alberta and the College of Nurses of Ontario.

In both of his practices, Luca regularly addresses novel issues raised by emerging technologies such as biometrics, vehicle and device telematics, artificial intelligence, big data, electronic surveillance, and online behavioural advertising. He has deep industry knowledge in the automotive, life sciences, healthcare and retail sectors, and is particularly well-placed to assist clients operating in those areas.

Luca’s clients benefit from his project management skills and responsiveness, which he honed in his previous career as a post-production coordinator. In that capacity, Luca designed and implemented post-production systems for network television and studio film productions, including several in South America, Europe and Asia. Before transitioning to the law, Luca also directed, shot and edited several feature-length documentaries on a range of topics (including intellectual property law issues). Prior to joining Dentons, Luca articled with the Information and Privacy Commissioner of Ontario, where he assisted with investigations and reviews under Ontario’s public-sector privacy legislation and access-to-information judicial review proceedings.
