Description
Sean is an experienced litigator and employment lawyer, advising both businesses and individuals. Prior to rejoining Kelly Santini in 2021, Sean served as Director of Litigation & Employment to a publicly listed corporation, providing proactive advice aimed at preventing disputes from occurring and appearing before the courts around the world to advocate on his clients’ behalf when a dispute required judicial consideration.

In private practice, Sean has considerable experience advising clients in all aspects of employment law including wrongful dismissal claims, workplace harassment claims and investigations, and human rights. He has counseled countless clients with respect to the employment implications on mergers, acquisitions, and dispositions.

Sean is always conscious of the fact that his clients do not want to be embroiled in a dispute and he works tirelessly to find a resolution as quickly as possible, but on the best possible terms. He has successfully represented clients, both individuals and corporations, in front of the Ontario Superior Court of Justice, Ontario Court of Justice, the Court of Appeal for Ontario. In addition, he regularly appears in front of administrative boards, including the Human Rights Tribunal of Ontario, Workplace Safety and Insurance Board (WSIB), and professional disciplinary boards.

Sean has been responsible for litigation management of matters proceeding before countless foreign bodies including the United States District Court (SDNY; DNJ; WDTX), the British Columbia Supreme Court, Alberta Court of Queen’s Bench, and the Superior Court of Quebec. He has also represented clients in myriad international tribunals, including the Equal Employment Opportunity Commission, and the British Columbia Human Rights Tribunal.

Sean is cited in at least half a dozen legal textbooks, including the 8th edition of Allen Linden’s Canadian Tort Law. He also is the publisher of the law blog “Labour Pains,” which has been cited with approval by the Ontario Superior Court of Justice. Labour Pains was inducted into the Canadian Law Blog Hall of Fame in 2019, after having previously been named “the best employment law blog in Canada.”
