Description
Eliot Kolers is the Head of the Litigation & Dispute Resolution Group in the Toronto office, and a member of the firm’s Partnership Board and Executive Committee. Eliot is recognized by his peers as a leading litigator with vast expertise in the areas of corporate commercial litigation, class actions, securities litigation and competition litigation matters. He has represented clients in numerous complex and high-profile commercial cases involving oppression remedies, proxy contests, takeover bids, shareholder disputes, plans of arrangement and corporate governance matters, as well as expedited litigation matters in relation to contested corporate transactions.

Eliot has defended numerous class actions involving competition law, securities and privacy issues. He also represents clients in commercial arbitrations and frequently works closely with counsel from various U.S. and international jurisdictions.

Eliot regularly appears before the Commercial List of the Ontario Superior Court of Justice and all levels of Ontario’s courts, and has appeared in other provincial appellate courts, the Federal Court of Appeal and the Supreme Court of Canada. He has also appeared before the federal Competition Tribunal, the Ontario Capital Markets Tribunal (formerly OSC), and other regulatory and administrative tribunals.

Professional Activities
Eliot is a member of the Canadian Bar Association, the American Bar Association (Antitrust Law Section), The International Bar Association, and the Metropolitan Toronto Lawyers Association. He is a past Board member of The Advocates’ Society, a past executive of the Ontario Bar Association’s Civil Litigation Section and is a past Chair of the Canadian Bar Association’s Competition Law Section’s Class Actions and Private Enforcement Committee.

Eliot was the editor-in-chief of Class Action Defence Quarterly (published by LexisNexis) from 2014 – 2024.
