Description
Tosh is a litigator whose practice focuses on complex corporate commercial, intellectual property, and class action disputes. He frequently represents and advises regulated financial institutions, pharmaceutical and life sciences companies, and agricultural and environmental science companies. Clients and colleagues trust Tosh with their most novel and complex legal issues.

Tosh’s work for financial institutions ranges from class action defence and risk mitigation to complex commercial cases alleging novel interpretations of insurance policies. He has also represented and advised industry organizations on litigation and regulatory matters of great importance to their industries.

In his intellectual property practice, Tosh regularly prosecutes actions for patent infringement on behalf of international and North American pharmaceutical companies, including under the Patented Medicines (Notice of Compliance) Regulations. Valued for his eDiscovery expertise and attention to detail, Tosh helps clients efficiently navigate the demanding timelines under which such litigation often proceeds.

Tosh also represents agricultural and environmental science companies in litigation and regulatory matters, including proceedings for judicial review, and product liability class actions. Tosh’s expert knowledge of the Pest Control Products Act, and his background in planning and environmental science, help clients navigate their most complex matters.

Tosh has appeared as counsel at various levels of court across Canada, including the Ontario Court of Appeal, the Saskatchewan Court of Appeal, the Federal Court of Canada, and the Supreme Court of Canada.
