Description
Deepshikha Dutt is a partner in the Litigation and Dispute Resolution group in Toronto. She also co-leads the National Professional Liability subgroup. Her practice focuses on professional liability, class actions and insurance-related matters, primarily dealing with directors and officers (D&O), and errors and omissions (E&O) liability.
An adept commercial and civil litigator, Deepshikha represents individuals and companies in a variety of commercial and insurance-related disputes, including contractual and shareholder disputes, oppression claims and securities litigation involving secondary market misrepresentations, negligence and negligent misrepresentations.
With extensive experience in trials, summary dismissals and appeals, Deepshikha has a proven track record of achieving favourable outcomes for her clients. She has appeared before all levels of court and administrative tribunals in matters involving issues of professional negligence, product liability, fire loss real estate, copyrights, defamation, fraud, conspiracy, financial schemes, environmental issues and complex class actions brought under the Class Action legislation. Notably, she successfully represented the D&Os of a financial institution in an eight-week trial involving fraud, negligence and negligent misrepresentation in an offering statement. Deepshikha has also successfully represented insurers in coverage applications and advises clients on various coverage matters, including CGL coverage, environmental coverage, D&O coverage, and priority issues involving multi-jurisdictional and multi-entity insurance policies.
To complement her robust litigation practice, Deepshikha has an active alternative dispute resolution practice, representing clients in arbitrations and mediations. In addition to her Canadian practice, Deepshikha is also a licensed lawyer in India with the Bar Council of India. She is also involved with several pro bono projects with the Firm.
